The well-known pharmaceutical company Allergan has signed an agreement with a Native American tribe regarding a group of patents protecting their ophthalmic drug “Restasis®”. Allergan has transferred the set of patents to the Saint Regis Mohawk Tribe which, in turn, will invoke its supranational immunity to Industrial Property litigation, in an attempt to block a lawsuit brought to the Patent Trial and Appeal Board of the United States Patent and Trademark Office.

The Tribe will then grant Allergan an exclusive license to the set of patents, in exchange for annual royalties worth 15 million dollars. It is worth noting that Restasis® earned Allergan 336.4 million dollars in the second quarter of 2017 alone.
